Before using any of SOWA’s digital platforms, please read the following to learn how SOWA uses your personal information.

This privacy policy has been written in German and translated into other languages. In the event of any discrepancies between the different language versions, the German version shall take precedence and be authoritative for interpretation.

YOUR DATA IS PROCESSED IN SWITZERLAND.

Collection of personal data and type of use by SOWA.

The processing, collection and use of your personal data is always based on a legal basis, which may be the performance of a contract with you by SOWA, your voluntary consent, compliance with a legal obligation or the legitimate interest of SOWA.

Specifically, SOWA may use your personal data for the following purposes:

– Offering and improving SOWA’s digital platforms.

– Offering and presenting SOWA content

– Manage your membership of SOWA

– Ensuring the use and ease of navigation of SOWA’s digital platforms

– Producing, selling and issuing tickets

– Ensuring adequate customer service

– Providing information about SOWA products and SOWA events, as well as products and services of SOWA business partners and other third parties, if you have given SOWA your consent to do so

– Providing requested services

– Managing your account, including processing invoices

– general communication with you

– answering your questions and comments

– Notification of special offers that may be of interest to you

– preventing possible prohibited or unauthorized actions

– tailoring advertising to you

– Enforcement of our policies in collecting your personal information otherwise disclosed to you

Personal information collected by SOWA

SOWA collects the following categories of personal data from you when you use SOWA websites, among others:

For use of SOWA’s digital platforms: email address, last name, first name, country of residence, date of birth, gender, user name, password, IP address, company information and billing information.

Cookies

SOWA uses cookies when you visit SOWA’s digital platforms. Please read and study SOWA’s cookie policy for more information.

Automatic Information

SOWA automatically collects certain personal information stored on your computer when you visit SOWA’s digital platforms, whether or not you have created a user account. For example, SOWA collects your IP address, web browser, and reference website. It may also collect data about your location or your online activities on SOWA’s digital platforms. Thanks to the collection of this data, SOWA can adapt the content displayed to your usage behavior and track and analyze your use of SOWA’s digital platforms and service offering. This data is also used for the technical administration of SOWA’s digital platforms and to optimize the user-friendliness and functionality of SOWA’s digital platforms.

Sharing and disclosure of data

SOWA may transfer personal data to third parties if:

(a) you acknowledge and consent to SOWA sharing your data with the following third parties involved in providing the services you have requested.

b) it needs to transfer your personal data in order to provide a product or service requested by you,

c) it provides the personal data to companies acting on behalf of SOWA in accordance with processing contracts that provide the protection for your personal data required by applicable law,

d) it is required to do so pursuant to a subpoena, court order or legal process,

e) it deems it necessary, in its sole discretion, to investigate, prevent, or take action regarding suspected fraud or illegal activities, and in emergency situations involving potential threats to the physical safety of any person, or violations of its policies or other legal requirements,

f) you have freely consented to the disclosure of your personal data to business and/or contractual partners of SOWA in order to inform you about their products and services.

Security

SOWA wants you to feel secure when using SOWA’s digital platforms. For this reason, we have taken appropriate technical and organizational measures to protect your personal data from accidental loss and unauthorized access, use, alteration or disclosure. However, SOWA cannot preclude malicious access to your personal information by unauthorized third parties.

SOWA takes identity theft and phishing very seriously. Protecting your information from identity theft is therefore a top priority. We will never request your credit card information, user account ID, login password, or national identification numbers in unsecured or unsolicited email messages or phone calls.

SOWA has procedures in place to respond to unauthorized access, use, alteration or disclosure. All suspected cases must be reported to SOWA via info@sowa.ch.

If you communicate with SOWA via e-mail, please remember that Internet e-mail is not secure. If you send sensitive or confidential e-mail or information unencrypted, you accept the risk of lack of confidentiality on the Internet.

Your rights

According to the DSG and DSGVO, you have the following rights:

a) Right to information about the collection and use of personal data.

b) Right to information about the personal data stored by SOWA about you

c) Right to rectification if personal data stored by SOWA about you is incorrect or incomplete

d) the right to erasure, i.e. the right to request SOWA to erase all personal data that SOWA holds about you

e) right to restrict the processing of personal data

f) right to transfer data, i.e. right to receive a copy of your personal data for use by other service providers or organizations

g) the right to object to the use of your personal data by SOWA for specific purposes

h) right to revoke consent given at any time

i) other rights regarding the refusal of automated decisions and profiling.

Complaints regarding the use of your data by SOWA should be sent to the relevant SOWA team via info@sowa.ch. The latter may ask you for appropriate proof of your identity. If you are not satisfied with our response, you also have the right to file a complaint with the Swiss Federal Data Protection and Information Commissioner (FDPIC) or the competent data protection authority in the EEA. To the extent SOWA is authorized under applicable data protection law, it may deny you access to your personal data under certain circumstances.

Updating and deleting your data

You may access, correct, update or modify your personal data or request SOWA to delete it at any time through your user account on SOWA’s digital platforms. SOWA will delete the data unless there is a corresponding legal archiving obligation.

Links to other websites

This Privacy Policy does not apply to external websites that may be linked to from parts of SOWA’s digital platforms. If you click on an advertising link or any other link to a third-party provider, you will be redirected to that third-party provider’s website. SOWA has no control over third party websites and therefore recommends that you read and study the privacy policies posted on those websites to understand their practices for processing, collecting, using and disclosing personal information.

Changes to this Privacy Policy

This Privacy Policy is subject to change. If there is a change to the Privacy Policy, an updated version will be posted on SOWA’s digital platforms without delay. If you use SOWA’s digital platforms for the first time after the change, you will be deemed to have consented to the amended Privacy Policy.

Precedence

In the event of any inconsistency between this Privacy Policy and the terms of any third party privacy policy, the terms of this Privacy Policy shall prevail.

Jurisdiction and applicable law

This Privacy Policy and all matters arising hereunder shall be governed by Swiss substantive law, excluding its conflict of law provisions.

Any disagreement, claim or dispute between you and SOWA arising out of or relating to this Privacy Policy shall be resolved exclusively by the competent courts of Zurich 1. Each party hereby expressly consents to the venue and jurisdiction of such court.
